Teen who shot victim accused of botched robbery in Muhlenberg

A Muhlenberg Township teenager who was wounded in what police called a shootout during an attempted robbery of his teenage drug dealer over the summer has been charged with multiple felonies.

Hector L. Martinez, 16, of the 1000 block of Ithica Street was released pending an arraignment Monday night before District Judge Ann L. Young in Reading Central Court.

Muhlenberg police charged him this week with attempted robbery, receiving stolen property and firearms offenses.

He is the third teenager to be arrested and charged as an adult for their alleged roles in what investigators called a drug deal gone wrong outside a residence in the 300 block of Taft Avenue in the Riverview Park in the town on August 14.

According to court records:

Muhlenberg Police were dispatched to Penn State Health Urgent Care at 4301 N. Fifth St. Highway after a shooting victim, later identified as Martinez, was transported there in a private vehicle. Martinez handed the cellphone to the man with him, later identified as Brandon Otero, 16, of Reading, asking him to call a relative.

Otero took the phone and ran. The car they arrived in was left in the emergency parking lot

Martinez, suffering from a gunshot wound to the chest, was transported by ambulance to Reading Hospital.

Around this time, police were also called to the area of ​​Taft Avenue and West View Drive for shots fired. They found bullet casings from two different firearms outside a home in the 300 block of Taft.

The police searched the area of ​​the emergency center to find the man who ran away. A detective found Otero in the 4200 block of Fourth Avenue, about 1 ½ blocks from the medical facility. He had two mobile phones.

Investigators learned that Otero and Martinez arranged to meet Andy F. Ortiz Zavala, 17, of Muhlenberg Township to purchase marijuana. Martinez had previously bought drugs from him.

Otero knew the teenager had a gun when the two went to meet Ortiz Zavala in the area of ​​Taft Avenue and West View Drive shortly before 1 p.m. Neither Otero nor Martinez had money to pay for the drugs they he should have bought them.

Instead, the teenagers conspired to rob Ortiz Zavala, with Martinez telling Otero it was “payback” because he had been robbed by Ortiz Zavala in the past.

When Otero and Martinez arrived at the meeting location, Martinez hid while Otero went to speak with Ortiz Zavala. While they were talking, Martinez approached.

When Ortiz Zavala saw Martinez, he knew something was wrong. He and Martinez drew guns and exchanged fire. Martinez was hit once in the chest.

Otero drove the injured teenager to the emergency center. Martinez gave Otero the gun and told him to hide it under the seat of his car.

Social media posts, text communications and school records were used to identify Zavala.

The police found him and arrested him.

Ortiz Zavala, 17, of the 200 block of McKinley Avenue in Muhlenberg was charged with aggravated assault, possession of a firearm by a minor, possession of a firearm without a license, reckless endangerment and possession of a controlled substance controlled.

Otero, 16, of the 700 block of Moss Street was charged with robbery with threat of serious injury, possession of a firearm without a license, possession of a firearm by a minor and robbery.

Zavala and Ortiz were arraigned following their Sept. 16 preliminary hearings before District Judge Dean R. Patton. They remain in custody in lieu of $250,000 and $75,000 bail, respectively, pending court action.
